Terms and Conditions

Important Note: Please carefully read the provided information.

(A) Definition used in this context:

  1. “Gomove Delivery Co., Ltd.” refers to the name used in the provision of this service, operated under the management of Gomove Delivery (Thailand) Limited Company.
  2. “Gomove Delivery Application” refers to the application software used for communication and facilitating service request submissions by users for transportation services or the movement of goods, as determined by the service provider. This application aims to enhance convenience for users seeking efficient and timely transportation of goods within limited time frames. The application can be downloaded or accessed via the Gomove Delivery application or the Gomove Delivery website, through platforms such as the App Store and Google Play, as well as accessed using devices including computers, laptops, tablets, mobile phones, or other compatible devices. The devices used should support the operating systems of the application, such as iOS and Android.
  3. “Service Provision” refers to the act of providing services to users who intend to transport goods or items based on service requirements. This involves the submission of service requests through the Gomove Delivery Application or the Gomove Delivery website. This service also includes the services by drivers during the transportation process. The service is charged on a per-service basis, with each instance of service being provided to one user. This individual is referred to as the “Service Provider” in the following text.
  4. “Driver” refers to motorcycle riders, truck drivers, and drivers of 6-wheeled vehicles. Each type participates in driving to handle delivery tasks for goods or items requested by service users. The rate of participation is calculated as one participation per one service provided to one service user. These drivers agree to accept transportation jobs for goods or items requested by service users through the Gomove Delivery Application or the Gomove Delivery website.
  5. “Service User” refers to individuals who intend to utilize the service, with the service provider acting as the operator for the transportation of goods or items as requested by the user. The service request is made in the name of the service user themselves, and this request is submitted through the Gomove Delivery Application or the Gomove Delivery website. This applies regardless of whether the service user orders for their own benefit or for the benefit of others.
  6. “Transportation of Goods or Items” refers to the agreement to provide services to users for the transportation of goods or items. This includes services such as pickup and delivery, food delivery, item transport, and order fulfillment. These service requests are made through the Gomove Delivery Application or the Gomove Delivery website is inclusive of the entire process of arranging for the delivery of goods or items.
  7. “Gomove Delivery Website” refers to the online platform where details of the service provider are displayed, allowing users to access various services. The website address for visiting and utilizing these services is www.gomovedelivery.com.
  8. “User Agreement and Terms” refers to the most significant aspects of stipulating the agreement, terms, conditions, or guidelines for service users when using this service. It specifically outlines the roles and responsibilities of service recipients, exemptions from liability, and other related matters on the Gomove Delivery website or the Gomove Delivery Application. These terms may be periodically updated or revised, and the service provider reserves the right to notify users in advance about such changes. Users can review these details through the Gomove Delivery Application or the Gomove Delivery website.
  9. “Service Request” refers to the use of data, orders, or service request submissions within the Gomove Delivery Application or the Gomove Delivery website to arrange for the transportation or delivery of goods or items as intended by the service provider. Service users themselves are responsible for initiating these requests according to the terms and conditions of this service.
  10. “Top-up” refers to the action of depositing funds into the appointed service program by the company. Service users transfer funds into their account within the data system of the service provider to ensure sufficient funds for deducting charges incurred during each instance of utilizing transportation services for goods or items. The service fees are deducted from the account within the data system that the customer has deposited funds into. This account covers service charges, fees, and other expenses.
  11. “Insurance Coverage” refers to the company’s commitment to assume responsibility within a specified coverage limit for insurance purposes. This coverage protects against loss or damage to goods or items for service users as defined. In cases of loss or damage during service provision within the specified coverage limit, customers are provided with protection for each service utilization instance. This coverage limit is up to 3,000 Baht for motorcycles, 5-door cars, and up to 7,000 Baht for pickup trucks in all instances.
  12. “Additional Insurance Coverage” refers to the option to purchase for additional insurance coverage from the service provider. This coverage involves participating insurance companies that offer increased coverage for goods or items. This additional coverage enhances the insurance coverage limit for cases where customers are aware that the value of their goods or items exceeds the insurance coverage amount stated by the service provider in section 11 (and section (D), point 1). Details of purchasing or payment and the enhanced insurance coverage limit are specified in section (D), point 2. Service users also have the option to independently purchase insurance from other sources without the need to inform the service provider before transportation.
  13. “General Service User Group” refers to all service users who request transportation services for goods or items as intended by the service provider. Each service usage instance corresponds to one service provided to one service user, regardless of whether they are persons, legal entities, groups, or others.
  14. “Business Service User Group” refers to registered service users classified as business service users with the service provider. Typically, these users have methods of payment or top-up for service usage. They frequently or regularly request transportation services for goods or items as intended by the service provider. Each service usage instance corresponds to one service provided to one service user, or as agreed upon. This includes natural persons, juristic persons, groups, and others.

(B) Duties and responsibilities in the terms and conditions of the service user

  1. The service user agrees to transport goods or items in the capacity of the rightful owner, authorized delegate, or representative of the service user by legal means, and agrees to accept the terms and conditions of the service user provided by the service provider in all respects. If the service user does not accept the terms and conditions, please refrain from using the service and exit the service platform or cancel registration information on the GoMove Delivery mobile application or website at once.
  2. The service user agrees to transport goods or items in properly sealed or packaged containers or materials that meet the standards, free from any visible damage, tampering, breakage, destruction, deformation, decay, or any other non-standard condition before proceeding with the transportation of goods or items.
  3. The service user agrees to transport goods or items that are appropriately, secured and packaged according to the following standards:

    3.1) Goods or items that are easily breakable: The service user agrees to wrap or package them with standard, sturdy materials capable of effectively preventing breakage, better than the usual standard wrapping or packaging for general transportation. Additionally, the service user must:


              3.1.1 Notify in writing through the GoMove Delivery mobile application or website in every case where goods or items are easily breakable when making a service request.
              3.1.2 Use suitably-sized and clearly visible lettering or contrasting colors to indicate on the goods or items that they may be fragile, such as “Handle with Care,” “Fragile,” “Do Not Hang,” “Do Not Fold,” etc.

    3.2) Goods or items that are easily bent or damaged: The service user agrees to wrap or package them with standard, sturdy materials capable of effectively preventing bending or damage, better than the usual standard wrapping or packaging for general transportation. Additionally, the service user must:

              3.2.1 Notify in writing through the GoMove Delivery mobile application or website in every instance where goods or items are easily bent or damaged when making a service request.
              3.2.2 Use appropriately-sized and clearly visible letters or contrasting colors to indicate on the goods or items that they may be bent or easily damaged, such as “Handle with Care,” “Bendable,” etc.

    3.3) Perishable goods, food items, or cases requiring refrigeration during transportation: The service user agrees to wrap or package them with standard, sturdy materials capable of preserving the freshness and integrity of the perishable goods, food items, or items requiring refrigeration until they reach the recipient. The service user acknowledges that it is their responsibility to ensure compliance with standards and suitability for these cases during transportation. Additionally, the service user must:

              3.3.1 Notify in writing through the GoMove Delivery mobile application or website in every instance where perishable goods, food items, or items requiring refrigeration are being transported when making a service request.
              3.3.2 Use appropriately-sized and clearly visible letter or contrasting colors to indicate on the goods or items that they may perish or require refrigeration, such as “Handle with Refrigeration,” “Perishable,” “Do Not Tilt,” “Do Not Invert,” “Hot Items,” etc.

  4. The service user agrees to provide complete service usage details in the designated fields for service usage in the Gomove Delivery application and Gomove Delivery website as follows:

    4.1) Name, address, and contact phone number or mobile number of the service user.
    4.2) Name, address, and contact phone number or mobile number of the recipient of goods or items.
    4.3) Clear instructions or warnings (if any) for the transportation of goods or items in the remarks field, as specified in section B, such as “Handle with care,” “Perishable,” “Do not tilt,” “Fragile,” etc.
    4.4) In cases where the service user requests cash-on-delivery at the recipient’s end, the service user is responsible for specifying the total amount to be paid in the remarks field for accuracy and ease of verification and payment collection between the driver and the recipient.
  5. The service user hereby certifies and acknowledges that the goods or items transported or used through the service comply with all applicable laws. If it is later discovered that the goods or items transported by the service user are illegal or prohibited by law, the service provider shall not be held responsible and shall not incur any liability, whether legal or otherwise, individually or collectively, with the service user.
  6. The service user certifies and acknowledges that the goods or items transported through the service will have a value not exceeding the insurance coverage provided by the service provider for damage to goods or items, as specified in section (D), point 1. In the event of any damage or other situation for which the service provider is liable during the provision of the service, the service user agrees to accept the specified insurance amount as compensation even if the goods or items have a higher value than the insurance coverage.

    6.1) The service user agrees and acknowledges that in the event of a risk or hazard, they are solely responsible, and the service provider is not aware of the value of the goods or items. This service is solely for the transportation of goods or items. For goods or items before transportation, it is required to be securely packaged with suitable materials, as per the standards specified in section (B), points 2, 3, and 4. Therefore, the service provider disclaims any liability beyond the specified insurance coverage.
    6.2) The service user agrees and acknowledges that if the goods or items have a higher value than the amount specified in section (D), point 1, they will arrange additional insurance themselves, as it is their responsibility. Additional insurance can be obtained according to the value or amount deemed appropriate by the service user. In case of purchasing additional insurance from the service provider, details can be found in section (D), point 2.
  7. The service user agrees and acknowledges that they will arrange for transportation of goods or items that do not exceed the size and weight limits specified in section (E).

(C) Products or items prohibited for transportation in the provision of services

  1. All types of living animals.
  2. All types of hunted animals or their body parts, such as elephant tusks, shark fins, or any part or product made from animal parts, and any other items not intended for human consumption or any item that must be prohibited under international treaties, laws, and global customs.
  3. Human body parts or human ashes.
  4. Firearms, weapons, explosives, or any type of explosive devices, such as landmines.
  5. Items that are illegal, such as counterfeit goods, copyright-infringing goods, controlled substances, illegally obtained property, and any other items that are illegal, in violation of regulations, or in contravention of any laws or regulations of any country, including items that may be legally owned but are prohibited from being transported or moved in violation of the law, whether in their entirety or in part.
  6. Dangerous or potentially hazardous items, such as knives, swords, spears.
  7. Items that are easily perishable or more prone to decay than usual, which people commonly acknowledge and are aware of.
  8. All types of flammable substances, such as LPG and Natural gas.

(D) Insurance for Damages

  1. General Service Users shall assume responsibility within the insured amount as follows:

    1.1) General Service Users shall assume responsibility within the insured amount as follows: 

              1.1.1 Motorcycle – Not exceeding 3,000 Baht (Three thousand Baht only).
              1.1.2 Sedan Car (5-door) – Not exceeding 7,000 Baht (Seven thousand Baht only).
              1.1.3 Pickup Truck – Not exceeding 7,000 Baht (Seven thousand Baht only).

    1.2) Business Service Users shall assume responsibility within the insured amount as follows:

              1.2.1 Motorcycle – Not exceeding 7,000 Baht (Seven thousand Baht only).
              1.2.2 Sedan Car (5-door) – Not exceeding 15,000 Baht (Fifteen thousand Baht only).
              1.2.3 Pickup Truck – Not exceeding 15,000 Baht (Fifteen thousand Baht only).

  2. If the service user acknowledges and agrees that in cases where the value or price of the goods or items being transported exceeds the amount specified in this section, but still wishes to proceed with the delivery, the service user can request additional insurance from the participating insurance companies through the “Additional Insurance” service. Please contact our sales department to facilitate coordination if the service user wishes to purchase additional insurance.

Note:

  1. This section in Clause 2 is applicable only if the service user intends to obtain additional insurance to mitigate the risk of high-value assets or items and is provided only for the convenience and promptness of service.
  2. The service user may independently purchase insurance from other insurance companies or as per their preference without the need to notify the service provider. However, in the event of an incident or damage of any kind, it is the responsibility of the service user to notify and arrange insurance with the insurance company or other external party themselves. The service provider reserves the right to undertake insurance only under Clause 1.

(E) Size and Weight in Service Provision

To prioritize safety, the service provider needs your agreement to transport or deliver goods or items based on their size and weight, as specified in the following rates:

  • a) Motorcycles
    – Transported with a weight not exceeding 20 kilograms.
    – Dimensions not exceeding (Width × Length × Height) 50 × 50 × 50 centimeters.
  • b) 5-Door Sedan Cars
    – Weight not exceeding 100 kilograms.
    – Dimensions not exceeding (Width × Length × Height) 115 × 115 × 80 centimeters.
  • c) Pickup Trucks
    – Weight not exceeding 1,000 kilograms.
    – Dimensions not exceeding (Width × Length × Height) 170 × 170 × 170 centimeters.

(F) In Case of Damage

  1. In the event that the transported goods or items receive any form of damage, the service provider will promptly notify the service user to inquire about steps, opinions, or recommendations for addressing the incurred damage. However, the service provider reserves the right to decide whether to act in accordance with the suggestions or recommendations of the service user in cases where the problem-solving approach exceeds the capabilities of the service provider or is deemed inappropriate or unreasonable for the circumstances.
  2. If the service user is informed of loss or damage as per Clause 1 but fails to provide appropriate instructions or opinions for resolving the issue within a reasonable timeframe, the service provider reserves the right to independently take appropriate and reasonable measures immediately, depending on the situation at the time, without waiting for guidance from the service user. Such measures may include resending the goods or items to the recipient, returning the goods or items to the service user, or storing the transported goods, items, or property. The service provider will inform the service user of each step taken.
  3. Any additional expenses incurred due to actions taken under Clause 1 and Clause 2 above shall be deemed the sole responsibility of the service user, unless the loss or damage results from the fault or negligence of the driver or the service provider’s failure to promptly address the issue, or in cases where joint responsibility is established. The degree of responsibility shall be apportioned according to the respective party’s liability as determined in each case.

(G) Exemptions from the Service Provider's Liability

  1. The service provider shall not be held responsible for any loss or damage incurred in any of the following circumstances:

    1.1) Liability for Transporting Goods or Items in Category (B), Specifically Category (B), Section 6, is Limited to Providing Insurance Coverage for Damages Up to the Rate Specified in Category (D), Section 1, and Includes Cases of Transportation Exceeding the Rates Stipulated in Category (E).

    1.2) Neglect, failure, or carelessness in notifying the driver or service provider and providing clear written warnings for items specified in Category (B), Sections 2, 3, and 4. In cases where there is no notification or clear warning on the goods or items on the shipping document and/or receipt, the service provider shall not be held responsible.

    1.3) Violations involving the transportation of goods or items in Category (C).

    1.4) Delays in delivery caused by third parties or external factors beyond the service provider’s control, such as legal inspections by law enforcement and government officials.

    1.5) Errors, negligence, or misconduct by other individuals not attributable to the service provider, such as damage caused by the recipient, government officials, authorized agents, or contracted individuals acting on behalf of the service user.

    1.6) The transportation of food items, flower arrangements, or other goods by motorbike when the packaging or transportation equipment is unsuitable or lacks sufficient protection against foreseeable damage, as determined by the service user. In such cases, any damage that may occur is the responsibility of the service user.

    1.7) Any damage caused by the driver during transportation that is not related to the goods or items being transported.

    1.8) In cases where the service user or their representative does not possess clear documentation or evidence of the goods or items transported by the service provider as specified, and in situations where tracking of the transported goods or items is required, the service provider reserves the right to disclaim any liability for damages incurred to the goods or items.

    1.9) Damage due to bending, wear and tear, explosions, breakage, deterioration, weakening, or melting of goods or items that the service user can reasonably anticipate may result in damage.
  2. Any resulting impacts or damages, whether direct or indirect, which may include but are not limited to, loss of income, profits, business benefits, as well as missed opportunities for generating revenue or reducing costs, or any other consequential effects that may occur subsequently, arising from the transportation of goods or items, regardless of whether the service provider was aware of these risks or not.
  3. The service provider shall not assume responsibility for any damage to goods or items that occurred before the goods or items were handed over for transportation by the user.
  4. In cases where damage arises from accidents or legal violations or constitutes any form of legal wrongdoing during transportation and there is no clear and verifiable evidence presented due to ongoing verification by government or private agencies, including cases where complaints have been lodged or criminal or civil actions have been initiated by any party, the service provider shall retain the right to refrain from any specific actions, such as tracking drivers or other parties, searching for evidence, or providing information to any party, except when legally required documents, such as witness subpoenas, physical evidence, or documentary evidence are presented to the user. This is to prevent the creation of false information or false evidence through malicious intent. In any case, the service provider retains the right to consider appropriate actions or actions deemed necessary after reviewing and clearly communicating the events that have occurred, as determined by government or private agencies, investigators, or the court, depending on the circumstances.

(H) Claims for Damages

  1. Users must initiate the claims process within 24 hours from the completion of the transportation of goods or items. If this time frame is exceeded, the service provider will not be liable for any damages.
  2. Consideration of any damages must be subject to the terms and conditions of the cargo and goods insurance as specified in the Gomove Delivery application and website.
  3. Claims must be made in writing and sent to the email addresses [email protected] and [email protected], and must include the following details:

    3.1) Shipment reference number.
    3.2) Service user’s contact information.
    3.3) Receipt or payment evidence.
    3.4) Photographs of damaged items.
    3.5) Copy of the bank account information for damage compensation.
  4. Claims for damages can be filed only once per user per transportation trip, referred to as one case. The service provider will process the payment for damages after concluding the assessment of each case.
  5. The service provider is responsible only within the limits specified, which are the actual damages, not exceeding 3,000 Baht for motorcycles or not exceeding 7,000 Baht for pickup trucks and 5-door sedan cars, in accordance with the damage insurance specified in Section (D), Clause 1.
  6. The assessment of damages will be completed within 15 business days from the date of receiving the damage claim. However, the service provider reserves the right to delay in cases beyond their control and cases where the service user was not informed in advance.
  7. The service provider will compensate for damages to the service user through bank transfers as provided by the service user or provide compensation in terms of the value of the lost items or damaged items, as assessed by the service provider, not exceeding the limits specified in Section (D), Clause 1, and (F), Clause 5.

(I) Limitation of Damage Claims

The service user agrees not to seek additional compensation beyond the terms and conditions of this user agreement, which may arise from personal responsibility or legal obligations related to claims for damages or any other expenses that may be incurred, not the responsibility of the service provider. This includes fees, fines, other expenses, or tax payments, customs duties, special insurance fees, as well as other cases where expenses may arise, whether before or after using the service.

(J) Withholding of Transport or Delivery Service Taxes

  1. In the event that the service user pays for the service in cash, it will not be possible to withhold the transport or delivery service taxes at the point of payment. If the service provider wishes to withhold these taxes, they must establish a business account with the service provider.
  2. For business customers of the service provider, it is possible to withhold a transport or delivery service tax of 1% from the amount of money transferred or deposited into the bank account established with the service provider. In cases where the service user conducts transfers or deposits through the GoMove Delivery application or the GoMove Delivery website, the system will automatically deduct a 1% transport or delivery service tax at the point of payment.
  3. Service users who have had a 1% transport or delivery service tax withheld agree to issue a withholding certificate at the point of payment and provide it to the service provider with the following details:

(K) Use of the GoMove Delivery Application and Website

  1. By requesting services or utilizing any features within the GoMove Delivery application or website, the service user acknowledges their agreement to use them solely for the intended purposes of the service provider.
  2. The service user agrees not to engage in any activities that may cause harm, destruction, devaluation, or render useless any data or information within the GoMove Delivery application and website.
  3. The service user shall not alter, modify, or engage in any actions involving the data within the GoMove Delivery application and website with malicious intent or for personal gain, whether directly or indirectly benefiting themselves or others.
  4. The service user shall not engage in any actions that may harm or damage the reputation, earnings, or any other benefits of the service provider, whether through verbal or written communication, advertisements, or any other means, within the data or other materials of the GoMove Delivery application and website, even in cases where data, evidence, or rights are lacking and can be performed legally.
  5. If any damages occur under this section, the service provider reserves the right to pursue legal action, whether civil, criminal, or in accordance with any applicable laws, and to claim for all resulting damages.

(L) Complaints or Suggestions

Users have the option to submit complaints, suggestions, or feedback of any nature for the purpose of initiating action, improvements, enhancing efficiency, providing service recommendations, or addressing other matters. These can be sent to [email protected] or [email protected].

(M) Amendments and Changes to User Terms and Conditions

  1. The service provider reserves the right to provide advance notice of any amendments or changes to the terms and conditions of service. Users can access and review details of these changes at any time through the GoMove Delivery application or website.
  2. The user terms and conditions were last updated on September 1, 2020.
